These are our standard booking conditions which apply to all challenges.

These are the terms and conditions of GBCE trading as GB Charity Events which apply to the charity or the trading company of the charity, known hereinafter as "the charity" that they will be participating in the fundraising event. Please refer to the charity’s own terms and conditions regarding your sponsorship and eligibility to travel. Only those potential participants who qualify under the charity’s rules will be entitled to travel. For those selected to travel, then the following conditions will apply:

IMPORTANT NOTE: Virtually all of our challenges take place in remote areas of the country, where we are unable to control or foresee the weather. No matter how much preparation and organisation goes into a challenge, things can and do go wrong, if any representative of GB Charity Events decides it is unsafe to continue with a particular aspect of the challenge, we reserve the right to change the itinerary for safety reasons. If you cannot accept certain last minute changes, please rethink before booking with us.

1. Participation

You need to be a minimum of 18 years old, in suitable physical condition to undertake the challenge as set out in the itinerary and be fully aware of the possible risks inherent in adventure travel. The outline itineraries given for each challenge must therefore be taken as an indication of what each group should accomplish and not as a contractual obligation on our part. It is a fundamental condition of joining any challenge that you accept this flexibility, and acknowledge that delays and alterations and their results are possible. It is in the interest of all members of the group that everyone should be capable of fully participating in the activities of their chosen challenge. With this in mind, please be aware that if it is felt that any participant is either not sufficiently fit, healthy, properly equipped or able to complete a challenge without affecting its safety, comfort or happy progress, GB Charity Events at any stage has the right to remove you from the challenge. Places are subject to availability and agreement from the charity (see point 2) and will be allocated on a first come, first served basis for those who properly complete the booking formalities. Bookings are non-transferable. We reserve the right on reasonable grounds to decline your request to participate in the challenge. Your entitlement to participate depends on our being satisfied that there are no circumstances under which we ought properly to decline your participation in the challenge. Our decision on your participation shall be final and binding. In any circumstances where we decide that you may not participate in the challenge any deposits or registration fees will be refunded to you in full. You must comply with the laws and regulations of the areas visited and comply with all reasonable instructions of the challenge leader relating to the safety and organisation of the challenge. If in our opinion, any airline pilot, accommodation manager or other person in authority feels that you are behaving in such a manner as to cause danger, distress or annoyance to others or cause damage to property, your challenge arrangements may be terminated by us or the supplier concerned. In such an event, we shall have no liability to you and will not be responsible for making any refunds, paying any compensation or meeting any costs or expenses you incur as a result. Furthermore, you must meet any expenses we incur as a result of your behaviour. You agree that any photography taken prior to, during, or after the challenge, which may include you in it, may be used in publicity material connected with the challenge, and that we will retain all rights, title and interest in such photography made by us including but not limited to any royalties, proceeds, or other benefits derived from such material. The challenge is based on using shared accommodation (where applicable), and if you join a challenge alone, you will be partnered with others of the same sex to share accommodation. Medical Treatment: It is a condition of joining a challenge that in cases of emergency we have your authority to arrange any necessary medical or surgical treatments and to sign any required form of consent on your behalf.

2. Registration

Depending on the charities choice of registration method:

i) Registration through the charity: If you are selected to take part in the fundraising event, we will be advised of your details by the charity. You will be informed by E-mail of your acceptance onto the challenge and the details of how to pay the initial registration fee.

ii) Registration through the GB Charity Events website: Participants are invited to apply through the website, which will form the initial application for a place on the challenge. The charity will then be responsible for selecting the participants from the online applications, using whatever methods the charity deems appropriate. You will be informed by E-mail of your acceptance onto the challenge and the details of how to pay the initial registration fee.

Once we have received your registration fee, your contract for travel, accommodation and other services (“your travel arrangements”) will be with us, GBCE Ltd whose registered address is Brooklyn House, Brook Street, Shepshed, Loughborough, Leicestershire LE12 9RG (company number 642884). We will then confirm our contractual commitment to you by sending you a confirmation invoice, together with the details of your travel arrangements and the itinerary that we have agreed to provide. It is only then that these terms and conditions will apply and a contract will exist between us, which is governed by English laws and the exclusive jurisdiction of the English Courts. Payment for your travel arrangements will be made to us by the charity from the sponsorship it has received in accordance with the charities’ terms for participating in the fundraising event.

No employee of GB Charity Events other than a director has the authority to vary or omit any of these terms or promise any discount or refund.

3. The price of your Challenge

The cost of your participation in the fundraising event forms a part of the overall value of the sponsorship raised by you and received by the charity in addition to the initial registration amount. From those sums received by the charity, the charity will pay to us the cost of your travel arrangements that we are agreeing to provide.

We reserve the right to increase the price of your travel arrangements to allow for variations in transportation costs (including the cost of fuel); dues, taxes or fees chargeable for services such as landing taxes and fees at airports and the exchange rate applicable to your travel arrangements. No price increase will be made within 30 days of your departure date and in any event, we will absorb any increase which equals 2% or less of the cost of your travel arrangements.

You are responsible to pay for your personal equipment, tips, additional food & drink, personal spending money, transport to and from the start location in the UK, and any other activities not included in the itinerary.

4. Health, Safety & Fitness and your Insurance Cover

The charitable event in which you will be participating is challenging and will require a good level of fitness, strength and endurance and it is your responsibility to ensure that you have the appropriate level. You should check with your doctor to ensure that you are sufficiently fit, healthy and mobile to participate in the event. Accordingly it is a compulsory term of travel that you take out travel insurance to cover any health or injury problems that arise. You must complete a medical form in order to be able to travel and you should also advise your insurer of any pre-existing medical condition before travel. Failure to advise this may invalidate your insurance cover.

5. Cancellation

(i) If you cancel your travel arrangements, then there will be no refund payable to you as your sponsorship was raised for charitable purposes. Any balance of the sum paid to us by the charity for your travel arrangements, after deduction of cancellation charges, which have been agreed with the charity, will be repaid to the charity.

(ii) Similarly, if we cancel your travel arrangements, the registration fee will be refunded to you and all other refunds or compensation will be paid to the charity.

(iii) If cancellation occurs in circumstances where recovery of cancellation charges is indemnified under your travel insurance, you hereby agree that you will co-operate in the recovery of these charges from the insurers and any sums recovered under the policy will again be paid over to the charity.

(iv) If cancellation occurs due to unusual and unforeseeable circumstances beyond our control, such as national emergency, natural disaster, fire, bad weather, flight delays or other such events (acts of force majeure), then we will advise you as soon as it is reasonable to do so.

We will not be liable to you for any incidental expenses that you may have incurred as a result of your booking, such as visas, vaccinations and non-refundable connecting flights or trains.

6. If we amend the itinerary

The itineraries and other details are published in good faith as statements of intention only and reasonable changes to the itinerary, vehicle and equipment use, may be made where deemed necessary or advisable. Sometimes this is due to improvements made as a result of client feedback. Other times, it has been made necessary through transport changes. In an adventure challenge the itinerary may be and often is changed at short notice due to changing weather patterns and other factors out of our control. While we will make all proper and reasonable efforts to maintain the advertised itinerary we do not guarantee that we can keep to the intended Itinerary and we therefore reserve the right to amend the itinerary of the challenge as and when it may become necessary to do so.

7. Standard and Quality of Accommodation and Services

You should not have unreasonable expectations of the facilities that will be provided which in some remote areas and some destinations may be below what you might expect at home. The level of the standard and quality of your travel arrangements will be in line with the itinerary and any literature you receive from us.

8. Liability

Clients together with their personal property including baggage, are at all times solely at their own risk. We accept responsibility for what our employees, agents, sub-contractors and suppliers do or do not do providing that they were at all times acting within the scope of or in the course of their employment with us and for any deficiencies in the services we are contractually obliged to provide or the failure of such services to reach a reasonable standard. In any such case our liability shall be limited to a maximum of twice your contribution towards the original challenge cost. Please note that we will not be liable for any injury, illness or death or consequent losses by you or any member of your group unless you are able to prove that such injury or illness was caused by lack of reasonable care and skill on the part of our employees, agents, sub contractors and suppliers in the performance of our obligations under this contract. We do not accept responsibility in respect of death, bodily injury or illness of any person participating in one of our challenges as a result of (but not limited to) physical exertion for which a participant is not prepared; forces of nature; consumption of alcoholic beverages; civil unrest; terrorism; breakdown of equipment; high altitude; lack of or limited access to medical attention in remote locations; and the adequacy of medical attention once provided; or where the cause was your fault, the actions of someone unconnected with the challenge arrangements. In all claims of whatever nature we will not be liable where the alleged loss or damage results from any of the following:-

1. the fault of the person(s) affected or any member(s) of their party, or

2. the fault of a third party not connected with the provision of your challenge which we could not have predicted or avoided, or

3. an event or circumstances which we or the supplier of the service(s) in question could not have predicted or avoided even after taking all reasonable care, or

4. the fault of anyone who was not carrying out work for us (generally or in particular) at the time.

Where the services in question consist of carriage by air, by sea or rail or the provision of accommodation, the extent of our liability will in all cases be limited as if we were carriers under the appropriate Conventions, which include The Warsaw/Montreal Convention (international travel by air); The Athens Convention (with respect to sea travel); The Berne/Cotif Convention (with respect to rail travel) and The Paris Convention (with respect to accommodation arrangements). We do not accept any responsibility for disruption, inconvenience, cancellation or alteration to challenges due to problems caused directly or indirectly by computer problems, where these problems are not our fault or the fault of our suppliers or could not have been avoided even though all reasonable care has been taken. If you book any additional activities locally, which are not a part of the original challenge itinerary, your contract is with the local company operating the activity and we have no liability or responsibility for the operation of the activity. You must if we are adjudged to have, or if we accept, liability for a claim that you make, assign to us any rights that you may have against any of our servants, agents or suppliers which is in any way responsible for the failure of your challenge or any death or personal injury you may suffer. You must also co-operate with us with any claim we choose to bring against any third party which we, in our discretion, deem to be so responsible.

9. risks

An adventure challenge is not without risks. You must be adequately fit to cover the distances and undertake the program set out in your challenge itinerary. You therefore take part entirely at your own risk and agree to indemnify us, the Charity, our employees, agents, sub-contractors and suppliers against claims for loss or damage to personal property or for loss or consequential losses or claims through your participation in this challenge arising from your own actions. Cyclists must wear a helmet meeting UK standards when riding. All participants must wear safety clothing or equipment such as may be required in the country concerned or under the rules and regulations of any local service provider of any activity undertaken by you. For water-based activities you must be able to swim 50 metres fully clothed.

10. Governing Law

This contract is governed by English law and the exclusive jurisdiction of the English Courts.

In the event that any clause or provision of these booking conditions shall be held to be invalid, the invalidity of such clause or provision shall not otherwise affect the remaining provisions of this contract, which shall continue and be enforceable.
